Durkheim argued that as societies moved from mechanical to organic
solidarity as a type of "social glue," systems of punishment/law would
move from repressive/punitive to restitutive/restorative. Some, however,
would argue that this hasn't occured in the U.S., as both civil and
criminal law seem to increasingly reflect punitive/repressive justice.
